PURPOSE AND ACCEPTANCE

This Legal Notice governs access to, browsing of and use of the website www.turbointernacional.com (the “Website”), owned by Turbo Reparación y Mantenimiento Internacional, S.L. (the “Company”).

Accessing the Website confers user status and implies full and unreserved acceptance of every provision of this Legal Notice in the version published at the time of access. Users who do not agree with its content must refrain from using the Website.

The Website is informational and commercial in nature: it presents the Company’s services, capabilities and network, and allows information or quotations to be requested. It is not an online shop: no sales contracts are concluded and no payments are made through the Website. All sales of goods and provision of services are governed by the general terms and conditions of sale and by the quotation accepted in each case.

CONDITIONS OF USE

Users undertake to use the Website in accordance with the law, this Legal Notice, good faith and public order, and to refrain from:

INTELLECTUAL AND INDUSTRIAL PROPERTY

All Website content — text, photographs, illustrations, videos, graphic design, navigation structure, source code, trademarks, trade names and logos — belongs to the Company or to third parties who have authorised its use, and is protected by national and international intellectual and industrial property law.

In particular, “Turbo Internacional” and its logo are protected by Spanish national trademark no. M3581739(9), owned by the Company. Their use without prior written authorisation is prohibited.

Third-party trademarks. The names, trademarks and models of turbocharger and engine manufacturers appearing on the Website (including ABB/Accelleron, MAN, KBB, Napier, Mitsubishi, MTU, PBS, IHI, Garrett, Hedemora and EMD) are the property of their respective owners and are used for identification and descriptive purposes only, to indicate the equipment the Company services and supplies parts for. Their presence does not imply any affiliation, sponsorship or association with those manufacturers, except where expressly stated.

Accessing the Website grants users no right or title over this content. Viewing, printing and downloading is permitted for personal and private use only; reproduction, distribution, public communication, transformation or any form of commercial exploitation without the Company’s prior written authorisation is prohibited.

LINKS

Links to third parties. The Website may contain links to sites operated by third parties. The Company does not control those sites and is not responsible for their content, services or privacy policies. A link does not imply any recommendation or relationship with the linked site.

Links to the Website. Links to the home page are permitted provided they are made fairly and lawfully, do not reproduce the linked content or present it in a way that misleads as to its origin, and involve no false or inaccurate statements about the Company. A link shall in no case imply a relationship between the Company and the owner of the linking site.

DISCLAIMER OF WARRANTIES AND LIABILITY

The technical and commercial information published on the Website is indicative and does not constitute a binding offer, individual technical advice or a recommendation to intervene on any specific unit. Determining the applicable solution for a given turbocharger or installation requires a specific diagnosis and is set out, where applicable, in the quotation issued by the Company.

The Company endeavours to keep the information current and accurate but does not warrant the absence of errors, nor the permanent accuracy, completeness or currency of the content, and reserves the right to modify it at any time without prior notice.

The Company does not warrant uninterrupted availability of the Website and shall not be liable for damage arising from its unavailability, from network failures, or from viruses or harmful elements introduced by third parties, provided it has adopted reasonable security measures in line with the state of the art.

Nothing in this section excludes or limits the Company’s liability where such exclusion or limitation is not permitted under applicable law, nor does it affect the warranties set out in the general terms and conditions of sale.

DATA PROTECTION AND COOKIES

AMENDMENTS AND SEVERABILITY

If any clause of this Legal Notice is declared void or ineffective, that declaration shall not affect the validity of the remainder, which shall remain fully effective.

GOVERNING LAW AND JURISDICTION

This Legal Notice is governed by Spanish law.

For any matter concerning the interpretation, application and performance of this Legal Notice, the parties submit to the Courts and Tribunals of Madrid, expressly waiving any other jurisdiction that may correspond to them, without prejudice to the jurisdiction legally applicable to users acting as consumers.

The foregoing is without prejudice to clause 14 of the general terms and conditions of sale, which governs disputes arising from the sale of goods and the provision of services.
